The petitioner, who was party to a consolidation proceeding in respect of Village Khera Kalan, has filed this petition under Article 226 of the Constitution of India, seeking expeditious disposal of an appeal [Appeal No. 21/3/260/RA/N/11] filed by him before the Settlement Officer.

The petitioner originally filed an appeal against an order of the Consolidation Officer dated 22.03.2004 before the Settlement Officer. The Settlement Officer dismissed the appeal by order dated 15.09.2004, which was affirmed by the Financial Commissioner vide order dated 04.11.2004. Against these orders, the petitioner came to this Court in W.P.(C) No. 3945/2006. the Settlement Officer and remanding the matter back to the Settlement Officer for hearing of the appeals on merits. 3.

It is the contention of Mr. Anil Kumar Singh, learned counsel for the petitioner, that the appeal has not been disposed of despite the aforesaid orders and that certified copies of orders passed in the appeal are also not being made available to him.

Mr. Lalltaksh Joshi, learned counsel for respondent Nos. 1 to 3, who appears on advance instructions, submits that the consolidation proceedings were completed on 19.09.2022. However, he has no instructions as to whether the pending appeal of the petitioner has been disposed of pursuant to the order of remand dated 09.11.2010. 5.

In this view of the matter, the writ petition, alongwith the pending applications, is disposed of with a direction that in the event the appeal has already been disposed of, the Settlement Officer is directed to provide a certified copy of the order to the petitioner within two weeks from today and to furnish a copy to Mr. Singh as well. If the appeal remains pending, it be decided within a period of four months from today. Certified copies of the orders passed in the appeal may also be supplied, in accordance with applicable Rules, if any.

It is made clear that this Court has not adjudicated upon the rights and contentions of the parties.
