The Petitioner is the complainant in FIR No. 486/2007 dated 13th September, 2017, registered at P.S. Kashmere Gate, Delhi, under Sections 420/468/467/471/120B of the Indian Penal Code, 18601. 2.
Aggrieved by the protracted trial, the Petitioner had earlier approached this Court by filing W.P.(CRL) 1585/2021, seeking directions for expeditious disposal of the trial. Upon hearing the said petition, this Court, by order dated 24th August, 2021, passed the following directions: "1.
The hearing has been conducted through Video Conferencing. CRL.M.A. 13315/2021 2.
Exemption allowed, subject to all just exceptions. 3.
The application stands disposed of.

This petition is filed with following prayers: 1 "IPC"

(i) Issue an appropriate writ(s) in the nature of Mandamus to the respondents to expedite and conclude the trial of the present case (FIR 486/2007 PS Kashmere Gate (EOW Central) registered u/s 420/467/468/471/201/120B IPC) in a fixed time frame a on day to day basis, in the interest of justice.
(ii) Issue an appropriate writ(s) in the nature of Mandamus to the respondents monitor and ensure examination comparison that of the documents by FSL is completed as early as possible and preferably within such time as may be fixed by this Hon'ble Court. 5.
The learned counsel for the petitioner submits the FIR No.486/2007 under Sections 420/468/467/471/120B IPC registered at PS Kashmere Gate was lodged on the complaint of deceased father of the petitioner herein in the year 2007. The said FIR was transferred to EOW Cell as there were clear allegations of criminal conspiracy, forgery and cheating etc. It is submitted on 01.09.2014 the chargesheet was filed and charges are yet to be framed.

The learned ASC for the State appears on advance notice submits supplementary chargesheet qua FSL report was later filed, however, the learned Trial Court was of the view some additional documents be also sent to the FSL for their examination and report of such additional documents is yet awaited.

In the circumstances the petition is disposed of with a direction to the Director, FSL to expedite the examination of such additional documents and to submit its report before Investigating Officer within two months from today.

After filing of additional supplementary chargesheet qua additional documents, the learned MM shall expedite the trial, since the matter is quite old i.e., of the year 2007. Pending application(s), if any also stands disposed of.

A copy of this order be communicated to the Director FSL/learned Trial Court for information and compliance."

Pursuant to the aforesaid directions, the FSL report was submitted along with a supplementary charge-sheet, and thereafter, on 8th March, 2022, charges were framed and the trial commenced.

Mr. Sanjeev Bhandari, ASC for State, submits that out of 28 prosecution witnesses, 16 witnesses have been examined so far. 5.

months, which period has already elapsed and yet the trial has not concluded, direction is issued to the State to take immediate steps to ensure that witnesses are examined on the dates fixed by the Trial Court. The Trial Court is requested to conclude the trial within a period of four months from today.

The concerned Principal and District and Sessions Judge is directed to seek a progress report from the concerned trial Court regarding the status of the trial.

With the above directions, the present petition is disposed of along with pending application(s), if any.

Copy of the order be also sent to concerned Trial Court, as well as the concerned Principal District and Sessions Judge, for necessary information and compliance.
