A Petition under Section 528 of BNSS has been filed on behalf of the petitioner for quashing of FIR No.213/2016 under Section 354D/506 IPC registered at Police Station Shahdara.

Brief facts of the case are that the parties are distantly related through paternal uncle of the complainant. They became friendly with each other. The petitioner had threatened to upload the photographs of the complainant on social media and the complainant/respondent No.2 got an FIR No.213/2016 registered under Section 354D/506 IPC against the petitioner. It is submitted that both the petitioners and respondent No. 2 have already sorted out their all differences with the intervention of their respectable persons of the family and they have left no grudge or grievance against each other in any manner whatsoever. Therefore, the Petition be quashed.

The complainant is present in the Court and submits that the matter stands settled with the petitioner vide Settlement Deed dated 29.08.2024 without any pressure, force or coercion. The parties undertake to abide by the terms of the Settlement already arrived at between them. The respondent No.2/complainant has no objection if the FIR is quashed against the petitioner on account of the settlement already arrived at between the parties.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. 10.

In view of the submissions made, the Petition is allowed.

Accordingly, the FIR bearing No. 213/2016 registered at Police Station Shahdara, for offences punishable under Sections 354D/506 of the Indian Penal Code, 1860 with all the subsequent proceedings are hereby quashed qua the petitioner.
