Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 („BNSS‟) has been filed on behalf of the Petitioner, for quashing of FIR No.0326/2018 under Section 509 IPC and Section 12 POCSO, registered at PS: Kotwali, Delhi and all consequential proceedings emanating therefrom, in terms of Settlement Deed dated 07.07.2025. 4.

The aforesaid FIR was registered on complaint of Respondent No.2, who stated that she has two daughters. near her daughter and made obscene gestures with his mouth and hands. Her daughter told this to her, on which her husband called No.100 and the details of incident got recorded vide DD No.62A dated 19.10.2018. 7.
It is further submitted that on 20.10.2018, on the complaint of Respondent No. 2, FIR No.0326/2018 under Section 509 IPC and Section 12 POCSO was registered at PS: Kotwali, Delhi.

It is submitted that present FIR was a consequence of the disputes between the Petitioner and Respondent No.2, who were neighbours. It is stated that with the intervention of family members, relatives and well wishers, the Petitioner and Respondent No. 2 have amicably settled all their disputes and differences vide Settlement Deed dated 07.07.2025. 9.
The parties are present in the Court and have been identified by the IO. The parties submit that they have arrived at the settlement without any force, coercion and undue influence and pressure and they have signed the Settlement dated 07.07.2025 with their wish and will. 10.
In view of Settlement Deed dated 07.07.2025, present Petition has been filed.

Respondent No.2 is present and submits has no grievance against the Petitioner and also has no objection to the quashing of FIR. She submits that as she has now been married second time and has shifted from that locality, therefore, she does not want to pursue the present Petition on behalf of her minor daughter, to whom obscene comments and gestures were made by the Petitioner.

In view of the fact that the FIR in question was premised upon a neighbors‟ dispute between the Petitioner and Respondent No.2, which has been amicably resolved in terms of Settlement dated 07.07.2025. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Considering the fact that parties have settled their disputes and Respondent No.2 have also given no objection to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings arising out of the FIR.

Consequently, FIR No.0326/2018 under Section 509 IPC and Section 12 POCSO, registered at PS: Kotwali, Delhi and all consequential proceedings emanating therefrom are quashed.
