The present Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the petitioner seeking to set aside the Summoning Order dated 17.05.2024 passed by the learned Metropolitan Magistrate, New Delhi District, Patiala House Courts, Delhi in Complaint bearing CC NI Act No. 16323/2023.

The grounds on which the quashing of the Summoning Order dated 17.05.2024 have been sought by the petitioner are that there is no legally enforceable debt and the cheque does not bear his signatures. 3.
There is an alternate efficacious remedy available with the petitioner to file the revision before the learned Additional Sessions Judge against the Summoning Order dated 17.05.2024.

In view of above, the present petition along with the pending applications is disposed with liberty to the petitioner to pursue his remedy by the learned Additional Sessions Judge by way of revision.
