By virtue of the present petition, petitioner seeks transfer of Civil Suit No. 2490 of 2016, titled 'Mohan Lal vs. Vidya Devi and Ors.', from the Court of District Judge-02 (East District), Karkardooma Courts, Delhi to the Court of competent jurisdiction in Shahdara District, Delhi. 2.

Briefly put, it is the case of the petitioner that the although a Suit qua the same property involved therein was instituted before this Court, however, due to the Delhi High Court (Amendment) Act, 2015, the same was inadvertently transferred to Court of District Judge-02 (East District), Karkardooma Courts, Delhi instead of the court of competent jurisdiction in Shahdara District, Delhi. He submits that the said fact has been rightly recorded in the interim order dated 12.08.2024 passed by the learned District Judge.

Learned counsel for the respondents submit that in view of the submissions made in the present petition, they have no objection if the present petition is allowed and the relief qua transfer of the aforesaid Suit is granted.

As such, for the reasons stated and in view of the aforesaid statement made by the learned counsel for respondents, the present petition is allowed and Civil Suit No. 2490 of 2016, titled 'Mohan Lal vs. Vidya Devi and Ors.', presently pending before the learned Court of District Judge-02 (East District), Karkardooma Courts, Delhi, is hereby transferred to the court of competent jurisdiction in Shahdara District, Delhi.

The learned District Judge-02 (East District), Karkardooma Courts is directed to send the entire record pertaining to Civil Suit No. 2490 of 2016, titled Mohan Lal vs. Vidya Devi and Ors. to the concerned Court of Shahdara District, Delhi.

Accordingly, the present transfer petition is allowed and disposed of.

A copy of the present order be sent to District Judge-02 (East District), Karkardooma Courts, Delhi and the learned District Judge, Shahdara District, Delhi for information and compliance.
