After hearing arguments for some time, learned counsel for petitioner, whose application filed under Order I Rule 10 CPC was dismissed by learned Trial Court, submits that he does not press the present petition. He, however, submits that it be clarified that in case, the petitioner is compelled to file any suit, the findings recorded there should not come in his way. 2.

This Court has gone through the impugned order dated 28.05.2025 whereby the learned Trial Court has, merely, decided one application moved under Order I Rule 10 CPC, which had been filed when the case was already at the stage of defendant's evidence.

These observations are, obviously, tentative in nature and, therefore, the present petition is disposed of as not pressed by clarifying that if petitioner herein, is compelled to file any suit in future, such observations would not be read adverse to his interest.
