This appeal is disposed of with the consent order that while the appeal is disposed of as not pressed but since the respondent/defendant has received a sum of Rs.1,50,000/- from the appellant/plaintiff under the subject Agreement to Sell dated 25.1.2007, this amount of Rs.1,50,000/- along with interest at the rate of 71⁄2 % per annum till the date of payment will be made by the respondent to the appellant within a period of six months from today. 2.

In case the amount as stated above is not paid to the appellant within a period of six months, thereafter, the rate of interest will become 12% per annum from the date of Agreement to Sell i.e. 25.1.2007 till the date of payment.

The appeal is accordingly disposed of in terms of the aforesaid consent order.
