Petition under Section 482 of the Code of Criminal Procedure, 1973 (Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023) has been filed on behalf of the Petitioners for quashing of FIR No. 460/2022 dated 20.07.2022 under Sections 363/365A/376 of the Indian Penal Code, 1860 and Section 6/21 of the POCSO Act, registered at Police Station Patel Nagar, Delhi and all the consequential proceedings emanating therefrom. In terms of the Settlement between the parties, the Affidavit of No Objection of the Prosecutrix, has been annexed along with the Petition. 2.

Brief facts of the case are that the marriage was solemnized between Petitioner No.1/husband and the Respondent No. 2/wife on 31.07.2022. The Respondent No. 2/Prosecutrix submits that the Applicant was known to her since five years. Thereafter, she got married and now has a child. They all are living happily together.

It is further submitted that on the Complaint of the Respondent No. 2, an FIR No. 460/2022 dated 20.07.2022 under Sections 363/365A/376 of IPC and Section 6/21 of the POCSO Act, got registered at Police Station Patel Nagar, Delhi.

The parties are present before this Court in-person today and have been identified by their learned Counsel and Investigating Officer concerned.

The parties have submitted that all the disputes have been amicably settled and thus, no fruitful purpose will be served in continuing with the said FIR.

The present Petition has been signed by the Petitioners and are supported by their Affidavits. She endorses that she has not been coerced and making a statement voluntarily for quashing of the said FIR. 9.
In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is a family matter, no useful purpose will be served in continuing with the proceedings Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

Accordingly, FIR No. 460/2022 dated 20.07.2022 under Sections The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
