By this petition, the petitioner seeks furlough and also quashing of the order dated 17th January, 2018 passed by the Director General, Prison Headquarters declining to grant furlough to the petitioner. The petitioner has been convicted in case FIR No.GSFC under Section 302 IPC read with Section 46/16 (D) and 40, BSF Act, 1968, PS 23rd Bn. Headquarter, BSF, Distt. Uttardinagpur, West Bengal.

As per the nominal roll, the petitioner was earlier also granted parole by this Court twice, once in the year 2014 and thereafter in the year 2017. The petitioner has also been granted furlough twice by this Court besides one month's parole by the DG, BSF in the year 2011. There is no allegation W.P.(CRL) 893/2018
that the petitioner misused the concession granted to him while he was earlier granted parole/furlough. A communication has been handed over by learned counsel for respondent No.1 verifying that the family of the petitioner is resident of A-24, Gali No.1, Kutub Vihar, Phase II, Hanuman Chowk, Goyla Dairy, New Delhi-110071.

Since petitioner has roots in the society and has earlier availed the benefit of parole/furlough which concession he did not misuse, this Court deems it fit to grant furlough to the petitioner. It is, therefore, directed that the petitioner be released on furlough for a period of three weeks on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount subject to the satisfaction of the Superintendent Central Jail Tihar, further subject to the condition that the petitioner shall report to the SHO, PS Chhawla once a week on every Friday during the period of his furlough, furnish his mobile number which will be kept operational during the period of furlough, not leave the National Capital Territory of Delhi without prior permission of this Court and surrender to jail authorities on completion of the period of furlough.
