CRL.M.C. 899/2018 1.

The petitioner seeks quashing of FIR No. 17 of 2010 under Sections 354/506 of the IPC Police Station Moti Nagar, New Delhi on the basis of a memorandum of settlement dated 05.09.2017. 2.

The parties are neighbours residing in the same locality and with the intervention of elder members of the family as well as the society, they have settled all their disputes. 3.

Learned counsels for the parties submit that the parties have settled their disputes amicably.

Respondent no. 2 and 3 are present in court in person, represented by their counsels and are identified by the Investigating Officer. They submit that They have settled the dispute with the petitioner and are agreeable to the settlement and do not wish to press the criminal charges against the petitioner any further. 5.

In view of the fact that the disputes between the petitioner and respondent no. 2 and 3 have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating there from.

In view of the above, the petition is allowed, FIR No. 17 of 2010 under Sections 354/506 of the IPC Police Station Moti Nagar, New Delhi and the consequent proceedings there from are, accordingly quashed.
