% 31.05.2018 The complainant of the case Sh. Suresh Kumar s/o Sh. Surat Singh is present pursuant to the directions dated 30.05.2018. A submission has been made on behalf of the petitioner that the complainant had submitted to the effect that the complaint had been registered on the basis of misunderstanding which had been resolved vide a settlement executed between the complainant and the accused. The other three accused in the instant case are stated to be already released on anticipatory bail.
The complainant in reply the specific Court query submits that he does not oppose the prayer made by the petitioner seeking grant of bail in as much as there are two children born of the wedlock between the petitioner and the deceased daughter of the complainant and apart from the petitioner, BAIL APPLN. 454/2018
there is no other to lookafter the children. He also affirmed the factum of settlement having been executed between him and the petitioner and other accused persons.
Without any observations on the settlement documents or on the merits or demerits of the case and in view of the submissions made on behalf of the complainant who does not oppose the prayer made by the petitiner and the submissions made on behalf of the State, the applicant is allowed to be released on bail subject to the appellant furnishing a personal bond in the sum of Rs.1,00,000/- with one surety of the like amount to the satisfaction of the learned Trial Court and subject to the conditions that he shall not leave the country without the permission of the learned Trial Court and shall not intimidate the witnesses in any manner.
