% 09.02.2024 CRL.M.A. 4191/2024 Exemption allowed, subject to just exceptions. Application stands disposed of.

CRL.M.A. 4193/2024 Application under Section 482 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') read with Section 5 of Limitation Act has been preferred on behalf of the petitioner/applicant for condonation of delay of 35 days in re-filing the petition.

For the reasons stated in the application, delay in re-filing is condoned. Application is accordingly disposed of.

on behalf of the petitioner challenging the order dated 26.09.2023 passed by Learned MM-06 (C), Tis Hazari Courts, New Delhi, whereby the FIR was directed to be registered under Section 420 IPC. 2.

Issue notice. Learned APP for the State appears on advance notice and accepts notice.

Learned APP, on instructions of IO, submits that the petitioner has already joined investigation pursuant to the directions for registration of the FIR. However, the allegations could not be corroborated, since the incident pertains to year 2017 while the FIR has been directed to be registered in 2023, vide order dated 26.09.2023. It is also submitted that the custodial interrogation of the petitioner is presently not required and final report shall be presented in accordance with law, for consideration of the learned MM. 4.

In view of the statement of the learned APP for the State, learned counsel for the petitioner seeks to withdraw the present petition with liberty to file appropriate proceedings, if any, in the light of Final Report to be filed by the State.

Petition is accordingly dismissed as withdrawn. Pending applications, if any, also stand disposed of.
