The present Petition seeks to challenge an order dated 02.09.2023 passed by the learned SCJ-cum-RC, East District, Karkardooma Courts, Delhi [hereinafter referred to as the "Impugned Order"]. By the Impugned Order the Leave to Defend Application of the Respondent/tenant was allowed on a limited issue qua an additional accommodation. 2.
Learned Counsel for the Petitioner/landlord submits that the issue involved in the present Petition has been limited by the learned Trial Court to the availability of alternate accommodation. 3.
Learned Counsel for the Respondent/tenant submit that the matter is proceeding for trial before the learned Trial Court. Since the issue is limited, the trial can be concluded expeditiously. He, on instructions from the Respondent/tenant, further submits that the Respondent/tenant will not take any unnecessary adjournments before the learned Trial Court. The Respondent is bound down by the statement made by his Counsel.
3.2 The Petitioner/landlord shall also not take any unnecessary adjournments before the learned Trial Court.

In view of the aforegoing statement, learned Counsel for the Petitioner/landlord seeks to withdraw the present Petition with liberty to agitate all contentions before the learned Trial Court. 5.
The Petition is dismissed as withdrawn with liberty as prayed for. 6.
