O R D E R

% 27.02.2018 By this petition, the petitioner seeks extension of parole granted to her for the reason that after hip replacement she has been advised extensive physiotherapy and further treatment.

On a notice being issued a status report has been handed over which is taken on record. The case of the petitioner is that due to old age and weakness she fell on the floor in the jail premises on 16th August, 2017 resulting in fracture in hip and thigh and then she was admitted in Deen Dayal Upadhyay Hospital, Hari Nagar, where she was operated and plates were implanted at the fractured hip/thigh and the petitioner was granted parole for a period of one month. After grant of parole to the petitioner on 12th October, 2017 since the pain was unbearable, on the second opinion it was revealed that the surgery was flawed and ineffective and the plate implanted was not put at the site of the fracture. Thus the surgery of the

petitioner was conducted again on 1st November, 2017 and after the surgery the petitioner was discharged on 6th November, 2017. Since after hip replacement extensive physiotherapy was required, the petitioner sought extension of parole which was granted by this Court vide order dated 1st December, 2017 for a period of three months.

As per the Status report the medical documents placed on record have been verified. The son of the petitioner Tilak Raj is looking after the needs of the petitioner.

Considering the surgery performed on the petitioner and the post operational care required in case of hip replacement, this Court deems it fit to extend the parole to the petitioner for a further period of three months from the date when her parole expires on 28th February, 2018, on the same terms and condition as directed by this Court vide order dated 1st December, 2017 in W.P. (Crl.) 3226/2017.

Petition is disposed of. Order dasti.
