% 24.02.2020 This petition has been filed by the petitioner challenging the order dated 28.11.2011 passed by the Foreign Trade Development Officer visiting the petitioner with a penalty of Rs.25 lacs. It is the case of the petitioner that neither any show cause notice nor any opportunity of hearing has been granted to the petitioner before passing of the Impugned Order.

It is further asserted that even the Impugned Order was not served on the petitioner and the petitioner came to know of it only when the recovery proceedings had been initiated. The learned counsel for the respondents, on instructions submits that the respondents are ready and willing to grant an opportunity of hearing to the petitioner.

In view of the above, the Impugned Order is set aside leaving it open to the respondent to initiate proceedings against the petitioner, if

so advised, in accordance with law.

The petition is disposed of in the above terms. Dasti.
