CORAM:

HON'BLE MR. JUSTICE MANMOHAN

O R D E R

% 22.03.2017 Present contempt petition has been filed alleging wilful disobedience of order dated 05th September, 2016 passed in W.P.(C) 7747/2016 wherein respondent-EDMC made a statement that action with regard to unauthorised construction at property F-96, Gali No.5, Murti Wali Gali, Jawahar Park, Laxmi Nagar, Delhi, will be taken in accordance with law within four months after giving an opportunity of hearing to respondent No.2. Though learned counsel for petitioner states that no action with regard to unauthorised construction has been taken till date, yet learned counsel for respondent No.1, who appears on advance notice, states that the property in question has been sealed on 22nd February, 2017. He further assures and undertakes to this Court that further demolition action shall be taken in accordance with law.

Keeping in view the aforesaid statement/undertaking given by learned counsel for respondent No.1, which is accepted by this Court, the present contempt petition and application are disposed of as satisfied. At this stage, learned counsel for petitioner states that construction work is still continuing. In support of his contention, he refers to photographs at pages 17 to 19 of the paper book. However, from the said photographs, this Court is not able to make out that any construction work is continuing. MANMOHAN, J MARCH 22, 2017 js
