The learned counsel for the applicant submits that the bail application on merits was dismissed by the learned Trial Court way back on 16.03.2021. He submits that the trial has still not concluded despite the fact that the applicant is in custody since the year 2016. He submits that same is a change circumstance which entitles the accused to a file bail application afresh. He seeks liberty to withdraw the present application and file afresh before the learned Trial Court.

In view of the above, the present application is dismissed as withdrawn with the liberty to the applicant to file a fresh application before the learned Trial Court.

As and when any such application is filed, the learned Trial Court is directed to consider it on its merits in view of the changed circumstances.
