% 23.02.2018 The learned counsel for the petitioner fairly concedes that though there is a vacancy in the office of the Principal Judge, Family Courts for North-West District at Rohini Courts Complex, there is a Court of Additional Judge functional for the same District. If it were so, the petitioner should approach the Additional Judge invoking his jurisdiction under Section 4(1)(d) of the Family Courts Act, 1984 before coming to this court.

The counsel now seeks permission to withdraw the petition and the application filed therewith and instead approach the Additional Judge.

The captioned petition and the application filed therewith are dismissed as withdrawn with liberty as prayed granted. R.K.GAUBA, J.
