% 25.11.2024 CRL.M.A. 35233/2024 in CRL.M.C. 7346/2024 The present application has been filed under Section 528 BNSS for rectification of the order dated 17.09.2024.
It has been submitted that inadvertently, in paragraphs Nos. 9 and 11, the words "are quashed" are left to be mentioned. Issue notice.
Learned APP for the State as accepted the notice. I have gone through the order dated 17.09.2024. The order was passed in CRL.M.C. 7346/2024, which was filed for quashing case FIR No. 1695/2014 registered under Section 498A/34 IPC at PS Narela. The perusal of the order indicates that FIR No. 1695/2014 and all the proceedings emanating therefrom were quashed. However, inadvertently, it seems that the words "are quashed" are left to be mentioned in paragraphs Nos. 9 and 11.

Hence, the order is modified and the paragraph Nos. 9 and 11 of the order dated 17.09.2024 be read as under:

Both parties are present in court and have duly been identified by the IO. Respondent No. 2 submits that she has entered the settlement voluntarily without any fear, force, or coercion. She submits that other petitions have already been withdrawn or dismissed. And since the marriage between the parties has also been dissolved vide decree of divorce dated 25.07.2024, she has no objection if FIR no.1695 dated 23.12.2014 registered under Section 498A/34 IPC at PS Narela and all the other proceedings emanating therefrom are quashed.

Let the order dated 17.09.2024 be modified, and the Fresh order be uploaded.
