The petitioner by the present petition challenges the order dated 10.05.2024, passed by the learned Metropolitan Magistrate ('MM'), North West District, Rohini Courts, Delhi, whereby the application filed by the petitioner under Section 156(3) of the Code of Criminal Procedure, 1973 was dismissed. 2.

Concededly, the impugned order is also revisable before the Court of Sessions. The petitioner has an efficacious alternate remedy.

Considering the above, the learned counsel for the petitioner seeks liberty to withdraw the present petition and file an appropriate petition before the Court of Sessions. 4.

The petition is dismissed as withdrawn with the aforesaid liberty.
