This application has been filed seeking early hearing of the matter which is otherwise fixed for 28th October 2024, basis settlement arrived at between the parties by way of an MOU dated 27th September 2024, which is on record of this Court. The said MOU has been executed on behalf of petitioner by his nephew Shakir Khan.

Petitioner is stated to be in judicial custody in proceedings under Section 138 NI Act initiated at behest of the complainant. Vakalatnama on behalf of petitioner has been executed by petitioner in custody, duly attested by the Jail Superintendent. Petitioner's counsel states on instructions that petitioner has authorised Shakir Khan, his nephew to execute settlement on his behalf.

Both Shakir Khan, nephew of Multan Khan and complainant are present in the Court and are duly identified. 4.
As per the settlement / MOU dated 27th September 2024, it has been agreed between that Shakir Khan of Multan Khan, petitioner herein, shall pay the total amount of Rs.25,00,000/- to respondent no.2 in instalments. The first instalment of Rs.5 lakhs has already been paid and subsequent instalments are to be paid on specified dates, starting from 24th March 2025, as mentioned in the MOU.

Complainant acknowledges receipt of the first instalment and states that in view of settlement, he has no objection if the petition is disposed of. 6.
Accordingly, in terms of the above settlement, offence under Section 138 NI Act stands compounded.

Petitioner be released from jail, if not required in any other matter. 8.
Copy of order be sent to the Jail Superintendent for information and compliance.

Date of 28th October 2024, fixed earlier stands cancelled. 10.
Copy of order be given dasti under signature of the Court Master. 11.
