% 12.12.2024 I.A. 47995/2024 (u/O XXIII Rule 3 of CPC) 1.

This is a joint application filed under XXIII Rule 3 of the Code of Civil Procedure, 1908 ('CPC') on behalf of the parties for recording terms of settlement between the parties. The application has been duly signed by the representatives of the plaintiff and the defendant. 2.

Counsel for the parties point out that there is a typographical error in paragraph 5(a) of the application inasmuch as the present suit is to be decreed in terms of 'paragraph 3' of the application and not 'paragraph 4'. 3.

The terms of the Settlement are recorded in paragraph 3 of the application.

I have gone through the terms of the Settlement and find the same to be lawful.

The parties shall remain bound by the terms of the Settlement. 6.

In view of the order passed above in I.A. 47995/2024, the present suit is decreed in terms of the aforesaid settlement. 8.

The aforementioned application shall form part of the decree. 9.

Let the decree sheet be drawn up.

Since the matter has been settled between the parties at an early stage, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff, in terms of Section 16 of the Court Fees Act, 1870.
