% 23.05.2016 Cost has been paid by the applicant to the non-applicant in view of order dated 29th April, 2016 by way of cheque bearing No. 011002 dated 19th May, 2016, drawn on State Bank of India, Parliament House, New Delhi for a sum of Rs. 20,000/-.

Learned counsel for both the parties submit that before the Appellate Court, the respondents had given an undertaking on 18th May, 2016 in FA(OS) No. 30/2016(Commercial). In view of the undertaking, learned counsel for the petitioner submits that nothing survives in the matter and therefore he wishes to withdraw the present petition. The petition is accordingly disposed of.
