The petitioner retired from the services of the respondent-Jawahar Lal Nehru University ["JNU"] on 31.12.2024. Although he has filed this writ petition for release of leave encashment dues of 300 days, gratuity and other claims with arrears and interest, Mr. Neeraj Kumar Sharma, learned counsel for the petitioner, states that the petition is pressed only in respect of leave encashment.

Mr. Karan Prakash, learned counsel for JNU, who appears on advance instructions, submits that JNU has received requests of the petitioner, that his retirement benefits should be paid into a particular bank account, which is not the account into which his salary was being paid during his period of service. JNU is agreeable to depositing the leave encashment amount, as may be computed in accordance with the rules, into the salary account of the petitioner.

accommodation and JNU is entitled to recovery of occupation charges from him. He submits that the dues will therefore be remitted after adjusting the amount due, and subject to the petitioner vacating the official accommodation.

Mr. Sharma is agreeable to an order in these terms. 5.

The writ petition is therefore disposed of, with the direction that JNU will make the necessary computation and remit the leave encashment amount to the petitioner, after recovery of any amounts that be due from him, within one week after he vacates the official accommodation. The computation of the amount paid will also be given to the petitioner, so that his rights and remedies in this regard remain reserved.
