Issue notice. Mr. Manashwy Jha, learned Panel Counsel, accepts notice on behalf of the respondents.

The petitioner has filed the present writ petition under Article 226 of the Constitution, seeking a direction upon respondent No. 2 to decide his appeal in terms of order of this Court dated 06.03.2006 in W.P.(C) No. 5887/1999.

The aforesaid writ petition was directed against the order dated 15.04.1999 passed by the Lieutenant Governor in an appeal arising out of the order of the Additional Collector dated 30.09.1994. This Court set aside the impugned order and remanded the matter to the Additional Collector with the following directions:

I accordingly dispose of the writ petition quashing the order dated 15.4.1999 passed by the Lt. Governor in Appeal Case No. 151/98-CA as also the impugned order dated 30.9.1994 passed by the Additional Collector.

determine the issue of land holding held by the petitioner and his wife as on the notified date. While deciding the appeal, revenue record and in particular khasra girdawaries for the period prior to 1971 would be taken into account. Whether on the lands single crop or double crop was grown would be decided in the context of the khasra girdawaries. Further, order dated 22.11.1993 passed in Appeal No. 65/92 filed by Jai Inder Singh would also be taken note of."

Mr. Jha, learned counsel, appearing on advance notice, submits that he is awaiting instructions regarding whether the appeal has already been disposed of. Mr. V.P. Rana, learned counsel for the petitioner, however submits on instructions, that the petitioner has not received any order disposing of the appeal.

Having heard learned counsel for the parties, the writ petition is disposed of, with the direction that in the event the appeal has already been decided, a certified copy of the order shall be furnished to the petitioner as well as to Mr. Rana within two weeks from today. In the event the appeal is still pending, respondent No. 2 shall dispose of the same within a period of four months from today.
