O R D E R

% 21.03.2016 The facts of the present case, as related by learned counsel for the petitioners, are that vide order dated 22nd September, 2015, the petitioners were convicted under Section 138 of Code of Criminal Procedure and thereafter, a revision petition was filed against the order of conviction.

The revision petition was dismissed by the Court of Additional Sessions Judge on 13th January, 2016 and against that order, the present petition has been filed. It has been further submitted by learned counsel for the petitioner that now the matter is fixed before the Court below on 28th March, for consideration on the quantum of sentence.

Admittedly, the order of sentence could be passed after hearing the parties under Section 235 of Code of Criminal Procedure.

Accordingly, the present petition and application are disposed of with the observation that the petitioner would have right of hearing before the Trial Court.
