As noted in the previous order, the Petitioner has given up the challenge on merits to the order dated 15th April, 2024 passed by the District Magistrate (West). The short prayer made to the Court is for grant of three months' time to vacate the premises bearing No. GH-14/1144, third floor, Paschim Vihar, New Delhi- 110087.1 2.

Mr. R.K. Jain, counsel for Respondent No. 1 along with Mr. Ravinder Singh (Respondent No. 1 in person), states that they are agreeable to grant of three months' time to the Petitioner to vacate the premises, however, the 1 "property in question"

Petitioner must give an undertaking to the Court that she shall vacate the premises after the expiry of three months. Further, the Petitioner must not create any third-party interest in the property or remove any of the fixtures that belong to Respondents No. 1 and 2.

Having regard to the above, the present petition is disposed of with the following directions:

(i) The Petitioner shall give an undertaking in the form of an affidavit that they shall vacate the premises on or before 19th December, 2024 and a copy thereof shall be supplied to Respondents, within a period of one week from today.

(ii) The Petitioner shall not create any third-party interest or transfer the possession of the property in question to any other person. (iii) The Petitioner shall clear all electricity and water dues of the property in question up to the date of handing over of the possession of the property to Respondent No. 1.

(iv) The Petitioner shall not remove any of the fixtures installed in the premises in question which belong to the Respondents No. 1 and 2. (v) The above undertaking shall be filed in the form of an affidavit which shall also specify that the Petitioner has understood that any violation of the undertaking given to the Court, shall be deemed to constitute an action for contempt of Court.
