The present petition assails the decision taken by the National Joint Committee for the Steel Industry (NJCS) in its meeting held on 08.02.2023, for adoption of a formula for "Annual SAIL Performance Linked Incentive Scheme (ASPLIS)."

At the outset, learned counsel for the Steel Authority of India (SAIL) submits that a similar petition was filed in relation to earlier decision/s taken by the NJCS, being W.P.(C) 2696/2024. In the context of the said petition, the following order dated 22.02.2024 was passed by a coordinate Bench of this Court:

"1. Mr. Bhardwaj, learned counsel for the respondent no.1 appears on advance notice and submits that the respondent no.1 is an institution falling under the Schedule to Section 14 of the Administrative Tribunal Act, 1985 and as such, the present being a service matter, the Central Administrative Tribunal would have the appropriate jurisdiction to decide the lis.

2. In view of the above, as also in view of the provisions of Section 14 of the Central Administrative Tribunal Act, 1985, the petitioners are permitted to withdraw the present petition to file a fresh petition before the Central Administrative Tribunal in accordance with law.

3. The same is dismissed as withdrawn with liberty so sought is granted.

4. Pending applications also stand disposed of." 3.

It is submitted that in view of the aforesaid order, the present writ petition which is also is in similar conspectus, is not maintainable and it is open to the petitioner to agitate its grievances before the Central Administrative Tribunal (CAT).

In the circumstances, learned counsel for the petitioner seeks to withdraw the present petition with liberty to agitate its grievance/s before the Central Administrative Tribunal (CAT), as acceded to by the learned counsel for SAIL.

The petition is accordingly, dismissed as withdrawn, with liberty as prayed for.
