By way of the present petition under Article 226 of the Constitution of India, the petitioner has approached this Court assailing the Group Instructor/ Surveyor/ Assistant Apprentice Advisor (Junior) Recruitment Rules, 2024 notified by the respondent no. 1 on 19.07.2024. At the outset, the petition is sought to be opposed by the learned counsel for the respondent nos. 1 and 2 who submits that the present petition is not maintainable before this Court as the petitioner has an effective statutory remedy by way of an OA before the learned Central Administrative Tribunal.

In the light of this objection taken by the learned counsel for the respondents, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to approach the learned Central Administrative Tribunal.

Learned counsel for the respondents has no objection to this request. 7.

The writ petition is accordingly disposed of as not pressed with liberty to the petitioner to approach the learned Central Administrative Tribunal, seeking the same relief as sought in the present petition. We further make it clear that since this Court has not expressed any opinion on the merits of the petitioner's claim, it will be open for him to raise all the grounds, as permissible in law, including the grounds raised in the present petition before the learned Central Administrative Tribunal.
