Petition under Article 226 of Constitution of India read with Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking Parole for a period of 45 days. 2.
Learned ASC on behalf of the State has appeared on advance Notice and submitted that as per the contents of the Application, the Petitioner had sought Parole by moving an Application in June, 2025 on the ground of filing an SLP before the Supreme Court. However, the copy of the Application has not been placed on record.

Thereafter, the Petitioner had applied for Furlough for 03 weeks, which was being allowed by the Coordinate Bench of this Court vide Order dated 21.07.2025 for a period of 03 weeks.

As per the Jain Manual, the Parole Application can be entertained only after one month of surrender. Moreover, again the Parole has been sought on the same ground for which Furlough has already been availed. 6.

Considering that the Petitioner had moved an Application for Parole in June, 2025 after which Furlough of 03 weeks has already been availed and he has surrendered before the Jail Superintendent only on 15.08.2025, the Petition is hereby disposed of with liberty to the Petitioner to make a fresh Application for Parole in accordance with Rules, which may be considered by the authority in accordance with law.
