The present petition under Section 482 of the Code of Criminal Procedure, 19731 seeks quashing of FIR No. 154/2024, registered at P.S. Model Town against the Petitioner for the offences under Sections 385/387 of the Indian Penal Code, 1860.2 2.

Counsel for the Petitioner submits that pursuant to the registration of the subject FIR, the State conducted investigation and filed a cancellation report. In response, the Complainant filed a protest petition. On 1 "Cr.P.C."

consideration of the said protest petition, the Trial Court, by order dated 7th February, 2025, directed further investigation on specific aspects, observing as follows:

"Submissions heard. Reply to protest petition and other record perused.

The evidence in Investigation appears incomplete as key aspects remain unexamined. The IO has relied solely on WhatsApp's response without exploring alternative methods to trace the caller of extortion call. Additionally, despite IO himself noting at one point that the agreement appeared suspicious, no substantial inquiry was conducted into the financial transactions or digital evidence. The closure report does not analyse the location chart or IPDR addresses. Accordingly, further investigation is warranted on the following aspects:

1. Forensic Analysis of Accused's Devices: The accused's mobile phones and digital devices may be sent for forensic examination to ascertain any communication with the international number.

2. Notices to Google & Other Platforms: The IO shall issue necessary notices to Google and relevant service providers to determine if the international number is linked to any accounts. Efforts be made to obtain I-PDR address and location charts.

3. Examination of Referral to EOW or Another PS: The SHO shall simultaneously consider whether the matter warrants transfer to EOW or another appropriate police station in light of the financial aspects involved and submit a report on the same.

4. Jurisdictional Considerations: If any material emerges linking the offence to Model Town, all aspects, including cheating and forgery, shall be investigated.

Mr. Ajay Vikram Singh, APP for the State, on instructions from SI Sonal Raj of PS Bharat Nagar, submits that in compliance with the above directions, a further report has since been filed before the Trial Court in May 2025, which is presently pending consideration. 4.

In light of the above development, counsel for the Petitioner, on instructions, states that he would like to withdraw the present petition and take recourse to other remedies as available under law.
