The present application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (formerly Section 439 of the Code of Criminal Procedure, 19732) seeks regular bail in proceedings arising from FIR No. 447/2023 registered under Sections 392/506/34 of the Indian Penal Code, 18603 and Sections 12/14 of the Protection of Children from Sexual Offences Act, 2012 at P.S. Jamia Nagar.

The Applicant's bail application before the Sessions Court was dismissed on 8th November, 2023 wherein it was specifically observed that the investigation is at the initial stage and the chargesheet is yet to be filed. Thereafter upon completion of investigation the Applicant filed further bail 1 "BNSS"

applications before the Sessions Court, however, the same were dismissed as withdrawn.

Therefore, there is no judicial order by the Sessions Court deciding the Applicant's plea of change in material circumstances. 4.
In light of the above, counsel for Applicant, states that he would like to withdraw the present application and pursue his remedy before the Sessions Court.

Dismissed as withdrawn, along with pending applications, with liberty as aforesaid.

The Court has not commented on the merits of the case and all rights and contentions of the parties are left open. 7.
In the event such an application is filed, the Sessions Court shall consider and decide the same in accordance with law by examining the change in circumstances cited by the Applicant.
