By way of this petition under Section 34 of the Arbitration and Conciliation Act, 1996, the petitioner assails an interim award dated 09.08.2023 by which the learned Arbitrator has awarded an amount of Rs.12,30,24,023/- in favour of the respondents herein on the ground that the dues to this extent are admitted by the petitioner. 2.

After some hearing, Mr. Adeep Z. Naqvi, learned counsel for the petitioner, seeks permission to withdraw the petition. 3.

Mr. Naqvi submits that the petitioner would like to make an effort to settle the disputes with the respondent and seeks a reference to mediation. As the arbitral proceedings are already in progress, the petitioner is at liberty to make such a request before the learned arbitrator, who may take an appropriate decision. It is made clear that this Court has not expressed a view on this request, one way or the other. O.M.P.
