Petitioner is plaintiff before the learned Trial Court and has filed a suit which is summary in nature.

When appearance was entered into by the defendant, it was belated one but the learned Trial Court exonerated such delay. 3.

However, there was no change in the attitude of the defendant as even the application seeking leave to defend was filed belatedly. 4.

The grievance in the present petition is with respect to condonation of delay in belated filing of application seeking leave to defend. 5.

The next date before the learned Trial Court is 30th instant for filing reply to the abovesaid application seeking leave to defend. After hearing arguments for some time, learned counsel for petitioner does not press the present petition. He, however, prays that learned Trial Court may be requested to dispose of the application seeking leave to defend, as expeditiously as possible.

None appears on behalf of respondent despite advance notice. 8.

Keeping in mind the overall facts of the case and aforesaid statement made by learned Counsel for petitioner, while the present petition is disposed of as not pressed, the learned Trial Court is also requested to decide the abovesaid application seeking leave to defend, as expeditiously as possible. 9.

Pending applications also stand disposed of in aforesaid terms.
