O R D E R
% 10.10.2018 The present OMP was filed under Section 34 challenging the award by the Sole Arbitrator dated 17th July, 2010 under the National Stock Exchange of India's Rules, Regulations and Bye-laws. The parties have arrived at a settlement during the pendency of the present OMP and have executed settlement agreement dated 10th October, 2018. The original settlement deed has been placed on record along with an application under Order XXIII Rule 3. The disputes arising from the following proceedings have been settled vide the said Settlement agreement: -
1. O.M.P. (COMM) No.78/2017
2. O.M.P. (COMM) No.79/2017
3. O.M.P. (COMM) No.80/2017
4. F.A.O. No.309/2012
5. F.A.O. No.310/2012 The settlement deed is common to all the proceedings. The settlement deed is taken on record. It is signed by all the parties. The parties shall be bound by the terms and conditions contained in the settlement. The Petitioner has also agreed to not pursue the police complaint filed against the Respondent in terms of the settlement. It shall be ensured that the said term shall be adhered to.
Learned counsel for the Petitioner also submits that in terms of clause 7 of the agreement, the Petitioner would not conduct any trading in any of the trading accounts and would file an application for deactivating the trading accounts of the Petitioners and the connected Demat accounts. The OMP is disposed of as settled in terms of the settlement agreement dated 10th October 2018.
