Petition under Article 227 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the Chargesheet dated 03.07.2015 alongwith the FIR and all the proceedings emanating therefrom.

Essentially, the ground to challenge are on merits wherein it is asserted that Respondent No. 2 has admitted in the Petition under Domestic Violence Act that she has no issues with the Petitioners No. 1 and 2. Moreover, the only allegation against the Petitioners are that they prevent the Complainant from living peacefully with her husband. 3.
It is further submitted that arguments on charge are being addressed for the last many days. The quashing is sought on merits. 4.
Learned APP for the State submits that since the Chargesheet has already been filed and the arguments are being addressed on charge, the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. contentions raised herein may be agitated before the learned Trial Court. Submissions heard and record perused.

Essentially, the quashing of the FIR and the Chargesheet has been sought on merits as submitted by learned Counsel for the Petitioners. 6.
These grounds are already been agitated at the time of arguments on charge. There exists no extra ordinary circumstance for quashing of the FIR. 7.
Accordingly, the Petition alongwith pending Applications, is disposed of with liberty to the Petitioners to raise all these contentions on merit before the learned Trial Court.
