Petitioner is defendant No.1 before the learned Trial Court and his limited prayer in the present petition is to the effect that, though, the learned Trial Court had closed their opportunity to file written statement for the reason that the outer limit of 120 days had expired, despite above, defendant No.1 could have still, in permissible limited manner, be permitted to cross examine the witnesses of plaintiff.

The abovesaid contention is fallacious as the impugned order dated 26.05.2025 does not indicate that such right of defendant was either denied or declined.

On the contrary, stipulations mentioned in the order, whereby the Commission was appointed, go on to indicate that the defendant has been permitted to cross-examine the witness, with the stipulation that such deposition be recorded in a question-answer form. 4.

application before the learned Trial Court seeking one opportunity to cross-examine PWs whom she could not examine on account of some misunderstanding.

Present petition is disposed of as not pressed. 6.
Petitioner is always at liberty to take recourse to any judicial remedy as available under law and as and when any such application is filed, the learned Trial Court would dispose of the same in accordance with law, after giving due opportunity of hearing to both the sides. 7.
It is, however, clarified that this Court has not made any observation with respect to the merits of any such proposed application. 8.
Pending applications also stand disposed of in aforesaid terms. 9.
