Applicant seeks regular bail in a case arising out of FIR No. 443/2022, registered at Police Station Bhajan Pura for commission of offences under Section 302 IPC and under Section 27 Arms Act. 2.

There are two accused in all and other one is, reportedly, on interim bail, on account of some wedding in the family. 3.

Applicant is facing trial for committing murder and the murder in question was witnessed by one Sh. Aman Khan. A CCTV camera was also installed near the spot which captured limited aspect of both the accused fleeing away from the spot. Admittedly, the incident in question was not captured in CCTV.

As per story of prosecution, present applicant had given fist blows on the chest whereas his accomplice was armed with katta (country made pistol) and victim was shot dead by his such co-accused, albeit, in furtherance of common intention.

recovered from the house of present applicant and even forensic evidence corroborates the use of such firearm in the incident in question. 6.

There are 48 witnesses and all the material public witnesses have already been examined. Learned counsel for applicant submits that public witnesses have not supported the case of prosecution and the applicant has not even been identified by the concerned eyewitness. 7.

Nominal Roll of the applicant is on record which indicates that his age to be 30 years and he does not have any previous involvement of any nature whatsoever. He is in custody since 23.06.2022. 8.

Keeping in mind the period of incarceration and the fact that all the material public witnesses have already been examined and conclusion of trial would take some time, applicant is hereby admitted to bail on his furnishing personal bond and surety bond in a sum of Rs. 25,000/- each subject to the satisfaction of learned Trial Court, Chief Judicial Magistrate/Duty Judicial Magistrate First Class with the following conditions: - (i) Applicant shall not try to contact any of the public witness, directly or indirectly.

(ii) Applicant shall report to the SHO of the local area, once a month on Sunday at 10:00 AM and shall not leave the National Capital Territory of Delhi without prior permission of learned Trial Court. (iii) Applicant shall furnish a mobile number to concerned IO on which he can he contacted, if required. Such number shall remain operational and functional.
