This is an application under Section 11(6) of the Arbitration & Conciliation Act, 1996 for appointment of an Arbitrator to adjudicate the disputes which have arisen between the parties under the Master Loan Agreement dated 21.03.2024 by which the Petitioner extended a loan to the Respondents for the sum of Rs.30,26,788/-.

It is stated that since the Respondents did not adhere to the repayment schedule, the Petitioner issued a loan recall/termination notice dated 10.08.2024. Clause 8.2 of the Master Loan Agreement provides for an arbitration clause and the seat of arbitration is Delhi. 3.

A notice under Section 21 of the Arbitration & Conciliation Act has been issued to the Respondents on 11.06.2025. It is stated that since no payment was forthcoming, the present petition has been filed seeking appointment of an Arbitrator to adjudicate the disputes between the parties. 4.

sides, referred the parties to Delhi High Court Mediation & Conciliation Centre so that an attempt can be made to explore the possibility of amicable settlement. It is stated that mediation has failed. 5.

During the course of hearing, respective Counsel for the parties jointly request that an independent Sole Arbitrator be appointed to adjudicate the disputes between the parties.

Accordingly, Ms. Mehak Nakra, Advocate (Mob: 9871144582) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties.

The arbitration would take place under the aegis of the Delhi International Arbitration Centre (DIAC) and would abide by its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC.

The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the Arbitration & Conciliation Act, 1996 within two weeks of entering into reference.

All rights and contentions of the parties in relation to the claims/counter-claims are kept open, to be decided by the learned Arbitrator on their merits, in accordance with law.

Needless to say, nothing in this order shall be construed as an expression of this Court on the merits of the contentions of the parties. 11.
