The present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (corresponding to Section 482 of the Code of Criminal Procedure, 19732) seeks quashing of FIR No. 862/2021 dated 17th November, 2021, registered under Sections 323, 341 and 34 of the Indian Penal Code, 18603 at P.S. Subhash Place, and all consequential proceedings emanating therefrom. 2.

The case of the prosecution is that the Complainant, Sunita Yadav, resident of Shakurpur Village, alleges that on 16th November, 2021, she was physically assaulted and subjected to indecent behaviour by her mother-in1 "BNSS" 2 "CrPC"

law Manju Yadav (Petitioner No. 1) and brothers-in-law Nitin Yadav and Sachin Yadav (Petitioners No. 2 and 3). It is alleged that when the Complainant went to enquire from her father-in-law about the cleanliness of the kitchen and washroom, a quarrel ensued during which the aforesaid accused persons assaulted her with bricks, pushed her, and attempted to snatch her mobile phone, while also committing obscene acts. The Complainant's husband, Varun Yadav, allegedly intervened to stop the assault. Based on her statement, the FIR was registered. 3.

The parties state that they have amicably resolved the matter before the Counselling Cell of the Family Courts, North District, Rohini, Delhi and the Complainant/Respondent No. 2 has decided not to pursue the present FIR against the Petitioners. In this regard, an agreement was executed between the Petitioners and Respondent No. 2 on 15th March, 2024. 4.

A copy of the agreement has been placed on record and perused by the Court. As per its terms, the Complainant/Respondent No. 2 has mutually resolved all disputes and differences with the Petitioner and has agreed to voluntarily give her no objection to the quashing of the subject FIR. To this effect, her Affidavit/No Objection Certificate has been duly placed on record. The parties have further agreed to withdraw all proceedings pending before various courts.

The Complainant/Respondent No. 2, who appears before the Court in person and is duly identified by the Investigating Officer, unequivocally states that she does not wish to pursue the FIR proceedings. She confirms that her decision to settle the matter is voluntary and made without any undue influence or coercion. The Petitioners have also joined the proceedings in person and are duly identified by the Investigating Officer. light of the amicable resolution between the parties, the Petitioner seek quashing of the subject FIR and all proceedings arising therefrom. 6.

The Court has considered the aforenoted submissions. It is pertinent to note that the offences under Sections 323 and 341 IPC are compoundable in nature. However, that does not debar the High Court from resorting to its inherent power under Section 528 BNSS (corresponding to Section 482 CrPC) and pass an appropriate order so as to secure the ends of justice. 7.

Having regard to the nature of the dispute and the fact that the aggrieved parties have amicably settled the matter, this Court is of the view that continuation of the criminal proceedings would serve no useful purpose. In the circumstances, this is a fit case for exercise of jurisdiction under Section 528 BNSS, as the continuance of proceedings would amount to an abuse of the process of law and impede the ends of justice. 8.

Accordingly, the present petition is allowed and FIR No. 862/2021 dated 17th November, 2021, registered under Sections 323, 341 and 34 IPC at P.S. Subhash Place, and all consequential proceedings emanating therefrom are hereby quashed.

The parties shall remain bound by the terms of settlement. 10.

Accordingly, the present petition is disposed of along with any pending application(s).
