Petition herein is for quashing of an FIR No. 347/2025 dated 19.06.2025 registered at Police Station Rajouri Garden, for the offences punishable under Sections 125(b), 290, 3(5) of BNS and all further proceedings emanating there from, based on compromise between parties. 2.
Petitioners were carrying out demolition work in their building, due to which the wall of complainant's house kept shaking. Despite repeated complaints, they ignored her and continued using heavy machines. 2.1 One of the walls collapsed due to the demolition work, breaking the roof and causing injuries to her. Thus the FIR was registered. 3.

amicably settled between the parties as per the settlement agreement dated 14.08.2025, and both the injured (Respondent No.2) as well as the owner of the damaged property (Respondent No.3) have no objection to the quashing of FIR No. 347/2025. No useful purpose would be served by prolonging the trial. It is further submitted that the investigation is complete but no charge sheet has been filed, and part payment of the settled amount of ₹70,000/- has already been made by the petitioners.

Learned counsel for the respondents-complainants and learned Public Prosecutor concur with the fact of compromise and submit that in view of the compromise, they have no objection if the FIR in question is quashed. 5.
In the aforesaid backdrop, I have heard learned counsel for the Petitioners and Respondents.

Having perused the FIR and the case file, it is debatable whether the ingredients of the alleged offences, as per the penal sections invoked in the FIR are not made out.

Be that as it may, Complainant/ Victim is present in Court. On a query put to her as to the nature of injury, she did suffer some injuries but they were not of the nature so as to be called grievous. She further affirms that the settlement has been arrived voluntarily, without any duress of coercion. However, allegations of the injury being leveled in the heat of the moment and having compromised the matter, she does not want to press any charges against the petitioners. Thus, continuation of criminal proceedings would serve no useful purpose, constitute an abuse of the process of law, and place and unnecessary burden on the judicial system. In contrast, quashing the FIR in question would promote peace and harmony between the parties, particularly as the complainant does not wish to pursue the case The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

In the premise, applying the ratio in decision of Gian Singh v State of Punjab & Anr. (2012) 10 SCC 303, I deem it just and proper to invoke inherent powers of this Court under Section 482 of Cr.P.C. to avoid undue hardship to the private parties for mutual good relations and societal peace.\ 9.
Accordingly, the present petition is allowed. FIR No. 347/2025 dated 19.06.2025 registered at Police Station Rajouri Garden, for the offences punishable under Sections 125(b), 290, 3(5) of BNS, and proceedings emanating therefrom, against the petitioners, are hereby quashed. 10.
