Learned counsel for respondent also appears on advance notice and informs that the process of filing appeal has already been initiated and he submits that he would have no objection if the learned Executing Court takes up the execution in question on or after 04.09.2025. 2.

He submits such statement is based on the instructions of his client, who is also present in Court.

In view of the above, learned counsel for petitioner, at the moment, does not press his petition.

The petition is, accordingly, disposed of.

However, in view of the above, the parties would be at liberty to appear before the learned Executing Court on 04.09.2025 and learned Executing Court would be at liberty to proceed further with the execution in accordance with law.
