The limited grievance of the petitioner in the present petition is that despite status quo orders passed by the concerned Civil Court, some trespassers/suspicious persons have illegally occupied the property in question i.e. 19-B, DDA Flats, Opposite JNU Old Campus, Ber Sarai, New Delhi.

It is submitted that the same is in violation of the orders passed by the concerned Civil Court.

A Status Report has been filed by the SHO, PS Kishangarh, stating as under:

"2. During the course of enquiry, the subject property was visited by SI Dharmendra and it was found that one personnamely, Mr. Sunil Sjo Sh. Aditya Manujam Singh R/o H. No.IMI-B-10, Qutab Institutional Area, New Delhi, Age- 54 Years,is living along with his family, at the abovementioned property since 27.07.2024 and he is paying the rent to Mr.Raj Kumar Singh Chauhan (real' elder brother of thepetitioner). He further produced copy of Rent Agreement executed between Mr. Raj Kumar Singh Chauhan (first party) and Mr. Sunil Kumar Singh (2nd Party), which is attached with this report.

In the circumstances, after some hearing, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to file appropriate petition/application before the concerned Civil Court seeking requisite orders/directions.
