% 22.02.2018 Respondent no.2-Ms.Kavita Chauhan is present in Court and has been identified by SI Sonu of police station Samai Pur Badli. Respondent no.2 submits that she has settled the matter with petitioner vide Memorandum of Understanding dated 10th January, 2017 of her own free will and without any undue force, pressure or coercion. She further submits that her marriage with petitioner has already been dissolved by a decree of divorce by mutual consent passed by the Family Court, North District, Rohini Courts, Delhi on 23rd November, 2017.
Respondent no.2 submits that she has already received entire settled amount of `5 lacs and has no objection in case FIR is quashed.
Keeping in mind that a settlement has been arrived at between the petitioner and respondent no.2 voluntarily, in the interest of justice, FIR No. 345/2013 under Sections 498A/406/34 IPC registered at police station Samai Pur Badli and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
