The petition concerns alleged arrears of retiral benefits due to the petitioners from respondent No. 2 - HIL (India) Ltd. Mr. Yashvardhan, learned counsel for respondent No. 2, states, upon instructions, that a petition under the Insolvency and Bankruptcy Code, 2016, has been admitted in respect of respondent No. 2 and a moratorium is in place. 2.

Although the order is under appeal, Mr. Yashvardhan states that the moratorium is subsisting as of now, and the petitioners will be entitled to file their claims before the Interim Resolution Professional ["IRP"]. 3.

In view of the aforesaid submission, which is undisputed, the petitioners are permitted to withdraw the writ petition with liberty to approach the IRP. In the event the insolvency proceedings do not proceed on account of any orders passed in HIL's appeal, it will be open to the petitioners to revive the present writ petition.
