The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of writ in the nature of Habeas Corpus to the respondents for production of the wife and minor son of the petitioner before the Court.

The minor son along with his mother has been produced in the Court today.

The Status Report has been handed across the board by the learned Standing Counsel and the same is taken on record. It is submitted that the wife of the petitioner, at present, does not wish to go to her matrimonial home; that her statement has already been recorded at Anand Vihar Police Station.

On being queried, the wife of the petitioner submitted that she is not willing to go to her matrimonial house along with the petitioner, as she has faced domestic violence.

The learned counsel, at this stage, seeks permission to withdraw the present petition with liberty to file an appropriate petition before the appropriate forum.

Permission and liberty, as prayed for, in accordance with law, is granted.
