O R D E R

% 19.05.2016 CM No. 8059/2008 (u/Sec. 24 of The Hindu Marriage Act) Learned counsel for the appellant, on instructions, submits that appellant is willing to pay `2.50 lacs (Rupees Two Lacs Fifty Thousand Only) towards interim maintenance under Section 24 of the Hindu Marriage Act, 1955 (for short, the Act) from the date of filing of present application, i.e., 23rd May, 2008 till disposal of the appeal, i.e., 21st March, 2012. Learned counsel for the respondent, on instructions, submits that offer of the appellant is acceptable to the respondent. However, it is submitted that this compromise is only with regard to the interim maintenance during the pendency of appeal and will not affect the rights of the respondent to claim permanent alimony etc., if any, in appropriate forum.

Accordingly, application is disposed of with the directions to the appellant to pay `2.50 lacs to the respondent towards interim maintenance during the pendency of appeal under Section 24 of the Act. The settled amount of `2.50 lacs shall be paid in three instalments. The first instalment of `84,000/- shall be paid on or before 7th July, 2016. Second and third instalments of `83,000/- each shall be paid on 8th August, 2016 and 9th September, 2016 respectively.
