Mr. Manoj Chouhan, learned counsel appearing on behalf of the plaintiff after making brief submissions realizes that he has to undertake the exercise contemplated under Section 12A of the Commercial Courts Act, 2015. He, therefore, seeks liberty to avail the same with further liberty to file a fresh civil suit, in case, occasion so arises. 2.

Liberty, so prayed for, is granted.

With the aforesaid observations, the instant civil suit is allowed to be withdrawn. Accordingly, the same stands disposed of. 4.

Since the instant suit is sought to be withdrawn on the first date of hearing, the entire Court fee deposited by the plaintiff be refunded by the Registry.
