O R D E R

The present writ petition has been filed seeking directions to the respondent nos. 1 to 3, to take appropriate action against the unauthorized and illegal construction raised by respondent no. 4 on Khasra No. 1135, Near Hotel Grand Shobha, Mahipalpur, New Delhi-110037. 2.

Responding to the present writ petition, learned counsel appearing for the Municipal Corporation of Delhi ("MCD"), submits that the unauthorized construction in the property in question was booked on 19th May, 2025, followed by a Show Cause Notice dated 02nd July, 2025.

She further submits that a Work Stop Notice has also been issued to Police Station, Vasant Kunj (North). construction in the property in question, at present. 4.

However, the aforesaid statement is refuted by learned counsel appearing for the petitioner, who submits that there is still ongoing construction in the property in question.

Having heard learned counsels appearing for the parties and considering the fact that the MCD has already initiated action against the unauthorized construction existing in the property in question, it is directed that the MCD shall take requisite action, after following the due procedure, in accordance with law.

The MCD, as well as Station House Officer ("SHO"), Police Station Vasant Kunj (North), is directed to ensure that no further unauthorized construction takes place in the property in question. 7.

In case, the petitioner is aggrieved by any non-action on the part of the MCD, the petitioner shall be at liberty to approach the Special Task Force ("STF"), as constituted by the Supreme Court, in terms of the orders passed by the Division Bench of this Court in the case of Devender Versus Govt. of NCT of Delhi and Ors., in W.P.(C) 1807/2018 and Fazruddin Versus DDA and Ors. in W.P.(C) 4649/2017.

Further, in case, if the owner/occupier of the property in question is aggrieved by any action on the part of the MCD, he shall have liberty to seek remedies in accordance with law.

Noting the aforesaid, the present writ petition, along with the pending application, is disposed of.
